Employment Litigation and Advice

Ms. McInnes has successfully represented employers in a broad range of employment litigation, including claims of wrongful termination, wage and hour violations, harassment, discrimination, and retaliation. In addition, Ms. McInnes regularly responds to state and federal agency and charges of discrimination, harassment, and retaliation on behalf of employers.

For situations that have not evolved into litigation, Ms. McInnes offers expert, practical advice to employers on employment law and human resources issues, guiding employers on day-to-day compliance with California and federal employment laws and regulations. Ms. McInnes has drafted and reviewed hundreds of employee handbooks and policies, employment agreements, and compensation plans to ensure compliance with California and federal laws and regulations. She works diligently with clients to keep them up to date on the ever-changing California and federal laws impacting employment policy and practice.

Workplace Investigations

Employers are obligated to investigate when employees come forward with allegations of wrongful conduct. Sometimes Ms. McInnes acts as the investigator, at other times she hires an investigator, and serves her clients in her role as advisor and legal counsel. Ms. McInnes has been conducting investigations for more than 12 years. She has significant experience handling very sensitive investigations where the accusations have the potential to impact the employer’s public image or where they involve accusations against high level executives.

Harassment Prevention and Other Employee Training

For over twelve years, Ms. McInnes has conducted workplace training for groups of attorneys, business owners, executives, managers, and rank and file employees. Training topics have included a broad range of employment issues including harassment and discrimination prevention, ethics in the workplace, lawful hiring practices, the basic nuts and bolts of California’s employment laws, and compliance with wage and hour laws and regulations.

Ms. McInnes’ harassment prevention training is dynamic and engaging and helps employers meet the state-mandated requirement that experts provide such training to all managers and supervisors in businesses with over 50 employees.
